Terms & Conditions

1. The contest start date is October 22, 2007, 8:00:00 a.m. EST and the closing date is October 22, 2008, 4:59:59 p.m. EST (the "contest period"). NO PURCHASE NECESSARY.


2. To Enter: To enter and be eligible to win, entrants must visit the website www.walkondust.com or www.cityclean.ca  and complete in full the on-line contest entry form. Limit of one entry per person or per e-mail address per contest sponsor throughout the contest period. Entrants may obtain additional entries for monthly prizes by referring others to the contest. Entrants will receive one (1) entry for every valid referral they provide (referrer signs up for contest). Entrants will have until October 22, 2008 at 4:59:59 p.m. Eastern Standard Time EST (the "Closing Date") to visit the website and register for the contest. Entries become the property of Walk-on Dust Control (the contest sponsors) and will not be returned. The contest sponsors are not responsible for entries that may be lost, damaged, misdirected, illegible, delayed or not received.


3. Prizes:  (1) Instant prizes will be awarded to registered participants consisting of discounts for services/ products offered by Walk-on Dust ControlTwelve (12) monthly prizes per contest sponsor will be awarded consisting of free products/services provided by the appropriate contest sponsor redeemable in the name of the winner. One (1) Grand Prize will be awarded consisting of a 37" High Definition LCD Television with an approximate retail value of $1,000 CDN. Odds of winning depend on the total number of eligible entries received at the date and time of drawing. Prize discounts may be applied only toward new services/products.


4. Eligibility: The Contest is open to all legal businesses, institutions, organizations and their employees within Ontario, eighteen (18) years of age or older, on the day the entry is submitted. Only one monthly prize can be awarded to a participant. Employees of Walk-on Dust Control, their affiliated companies, its representatives or agents, advertising or promotional agencies, prize suppliers/sponsors and members of their immediate families (spouses, children, siblings and parents), or those living in the same household are not eligible. Contest is void where prohibited or restricted by law. The contest is subject to all applicable federal, provincial, and local laws and regulations. By participating, entrants agree to abide by, and be bound by, these Official Contest Rules and to accept the decisions of Walk-on Dust Control as final. All prizes must be redeemed by February 10, 2009 or will be forfeited.


5. Winner Selection: (1) Instant prizes will be automatically awarded to random registered visitors. (2) Monthly prize drawings: A random drawing will be conducted by independent judges in Welland, Ontario. On the 22nd of each month of the contest period at 5:00 p.m. EST, the independent judges will randomly draw from all eligible entries received by 4:59:59 p.m. EST on the date of drawing. (3) The Grand Prize random draw will be conducted by independent judges and will be held in Welland, Ontario, on or about October 24, 2008 at 5:00:00 p.m. EST from all eligible entries.


6.  Prize Winner Notification: Monthly prize winners will be notified by email or telephone. Grand Prize winners will be notified by either email or telephone. In order to win a prize, the winner must correctly answer, unaided, a time limited, arithmetical, skill-testing question.  The winner may also be required to sign and return the standard Declaration and Release Form and consent to the use of their name, city and/or photograph, without further compensation, in any marketing or publicity carried out by Walk-on Dust Control or their representatives or its advertising, marketing and promotions firm relative to this contest. Any taxes, fees or incidental charges applicable to any prize shall be the sole responsibility of the winner of the prize.


7. Additional Terms: By participating, entrants agree to: (a) these Official Contest Rules and the decisions of Walk-on Dust Control, which shall be final in all respects; and (b) release, discharge, indemnify and hold harmless Walk-on Dust Control & Superior Laundry Services Ltd. or City Clean, each of its respective subsidiaries, affiliates, officers, directors, and employees, including their promotional agencies, from any liability, claims, or damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the contest and/or the acceptance or use, misuse, or possession of any prize.

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE DRAW SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY, AND THE POTENTIAL WINNERS HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.


8. Limitation of Liability: Walk-on Dust Control shall not be responsible for print or typographical errors in any contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due requests; or for prize claims that are posted late or incorrectly or are lost due to computer or electronic malfunction. Walk-on Dust Control reserve the right to cancel or modify the Contest if fraud or technical failures compromise the integrity of the contest as determined by Walk-on Dust Control in their sole discretion.


9. Liability:  The winners, and those accepting the prizes with the winners, agree that the prizes are awarded on the condition that Walk-on Dust Control have no liability whatsoever for injuries, losses, or damage of any kind resulting from the participation in the drawing or resulting from the use or acceptance of any prize, or participating in any prize-related activities.


10. Limitation of Technical Liability: All entries/prize claims become the property of the contest sponsors, which assume no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or entry to be received by the contest sponsors on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to an entrant's or any other person's computer, related to, or resulting from, playing or downloading any material in the promotion. The contest sponsors reserve the right, in its sole discretion, to cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of the contest sponsors corrupt the security or proper administration of the contest.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws and should such an attempt be made, the contest sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.  Entries and prize claims are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. 


11. Dispute Resolution: Subject to other legal rights and remedies available to you under applicable provincial consumer protection laws, and subject to your consent, you agree that a simplified arbitration proceeding by a sole arbitrator shall be the initial recourse used to resolve any claim or dispute (whether originating in contract or tort, or pursuant to any applicable statutes, regulations or common law principles and whether past, present or future) that arises out of, or is related to: (a) these Contest Rules; (b) any oral or written statements; or (c) any promotions or advertisements related to the contest. You and the sponsor will make every reasonable effort to agree on the appointment of the arbitrator within fifteen (15) days of the commencement of the arbitration proceeding, failing which, the arbitrator will be appointed by the court in the Province of Ontario. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.
